Terms & Conditions

1. Acceptance of Terms

By accessing and using the Evershine Fireplace website (the “Site”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

 

2. Use of the Site

  • Eligibility: You must be at least 18 years old to use the Site.

  • License: Evershine Fireplace grants you a limited, non-exclusive, non-transferable, revocable license to use the Site for personal and non-commercial purposes, subject to these Terms.

 

3. Account Registration

  • Accuracy: You agree to provide accurate, current, and complete information during the registration process and to keep your information updated.

  • Security: You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account.

 

4. Orders and Payment

  • Product Availability: All products listed are subject to availability. We reserve the right to limit quantities.

  • Pricing: Prices may change without notice. In case of a pricing error, we will notify you and give you the option to proceed at the corrected price or cancel the order.

  • Payment: Payment must be made in full at the time of purchase using the methods available on the Site.

 

5. Shipping and Delivery

  • Policy: Our shipping policy, including rates and delivery times, is available on the Site. We are not responsible for delays caused by carriers or events beyond our control.

  • Risk of Loss: All purchases are shipped FOB (Free on Board). Title and risk of loss transfer to you once the item is delivered to the carrier.

 

6. Returns and Refunds

All sales at Evershine Fireplace are final. We do not accept returns or issue refunds for reasons such as change of mind, preference, or customer error.

Refunds or replacements are only available if:

  • The product arrives damaged during shipping, or

  • The product delivered is incorrect from what was ordered.

 

If you believe your product meets these conditions, you must notify us within 7 days of delivery by contacting sales@evershinefireplace.com with your order number, photos, and details of the issue.

Approved claims will be resolved at no extra cost to you by replacement, repair (where applicable), or a refund if a replacement is unavailable.

Nothing in these Terms affects your rights under applicable British Columbia consumer protection laws regarding defective or misrepresented products.

 

7. Privacy & Data Use

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Site, you consent to the practices described in the Privacy Policy.

 

8. Intellectual Property

  • Ownership: All content on the Site, including text, graphics, logos, images, and software, is the property of Evershine Fireplace or its licensors and protected by intellectual property laws.

  • Restrictions: You may not modify, reproduce, distribute, create derivative works from, or publicly display any content without prior written consent.

10. Disclaimers & Limitation of Liability

  • As-Is Basis: The Site and all products/services are provided “as-is” and “as-available.” We make no warranties, express or implied.

  • Limitation: To the maximum extent permitted by law, Evershine Fireplace is not liable for indirect, incidental, or consequential damages arising from your use of the Site or products.

 

11. Indemnification

You agree to indemnify and hold harmless Evershine Fireplace, its officers, employees, and agents against any claims or losses resulting from your violation of these Terms or misuse of the Site.

 

12. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law rules.

  • Before filing a claim in court, you agree to attempt to resolve disputes with us through good faith negotiation or mediation.

 

13. Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting to the Site. For significant updates, we will provide notice (e.g., email or website announcement). Continued use of the Site after changes constitutes acceptance.
